Pixokart

I. Acceptance of Terms

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree or are unable to be bound, you may not use the Services. Your acceptance may occur by (a) clicking to accept or agree where this option is presented in the user interface, or (b) actually using the Services, in which case we will treat your use as acceptance from that point onwards. Your use of the Services is at your own risk, including exposure to content that may be objectionable or inappropriate.

II. Definitions

User / You / Your: Any person who accesses or uses the Services, including users with access to a vendor dashboard.
Content: All forms of information or data, including reviews, images, photos, audio, video, messages, ratings, profile information, and location data.
User Content / Your Content: Content you upload or transmit through the Services.
Pixokart Content: Content created or provided by Pixokart in connection with the Services (e.g., interfaces, graphics, software, reports, and other elements), excluding User Content and Third-Party Content.
Third-Party Content: Content provided by parties other than Pixokart or its Users, available on or through the Services.
Studio: A registered photo studio business or individual professional photographer listed on Pixokart.
Vendor Listing: The page displayed for a registered and/or claimed vendor or business on the Services.
Studio Owner: The individual professional photographer or studio representative who registered as a Studio or claimed a Vendor Listing.

III. Eligibility & Account Registration

Eligibility. You must be at least 13 years of age and capable of entering into a legally binding agreement. If you are under 13, do not use the Services. If you are 13–18, you affirm you have parental consent.
Compliance. You agree to use the Services only in compliance with applicable laws and these Terms. By using the Services, you represent you are an Indian resident or otherwise lawfully using the Services in your jurisdiction.
Account Registration. To access certain features, you may need an account. You agree to provide accurate, current, and complete information and to keep your credentials secure. You are responsible for all activities that occur under your account.

IV. Changes to the Terms

We may amend these Terms at our sole discretion. Updates will be effective upon posting. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

V. Provision of Services

Modifications & Updates. We may suspend, modify, or discontinue any part of the Services at any time without prior notice. Updates and upgrades may be automatically delivered; some may be required for continued access.
Account Access. If your account is disabled or suspended, you may lose access to your account, content, or related Services.
Usage Limits. We may impose or change usage limits in the future.
Disclaimers (Service Content). Content on the Services is for informational purposes only. We do not guarantee quality, pricing, or availability of any vendor services and may correct or modify content without notice.
Certifications & Licenses. Certifications or licenses displayed on vendor listings are provided by vendors “as available.” We do not warrant their validity or accuracy.
Subscriptions & Programs. We may introduce or modify fees, subscriptions, or incentive/referral programs with notice where reasonable; participation is subject to program-specific terms.

VI. Intellectual Property & Content Rights

1. Ownership of Pixokart Content and Marks

Pixokart owns the Services and all associated intellectual property rights worldwide, including copyrights, trademarks, service marks, trade names, trade dress, logos, designs, databases, compilations, and software (“IP Rights”). Unless expressly authorized, nothing in these Terms grants you rights to use Pixokart’s IP Rights or distinctive brand features.

2. Limited License to Pixokart Content

Subject to these Terms, Pixokart grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Services and Pixokart Content for lawful purposes. You may not copy, modify, distribute, publicly display, frame, mirror, remove notices from, or create derivative works of the Pixokart Content without prior written consent, nor reverse-engineer or attempt to extract source code.

3. User-Generated Content (“User Content”)

Ownership. You retain ownership of your User Content.
License to Pixokart. By submitting User Content, you grant Pixokart a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, display, reproduce, adapt, modify, translate, create derivative works from, commercialize, analyze, publish, distribute, and otherwise use such content to operate, promote, and improve the Services (including marketing and API/partner integrations). You also grant the right to use names, business names, trademarks, logos, and usernames submitted with your content. To the maximum extent permitted by law, you waive any moral rights or rights of attribution in your content.
Representations. You represent and warrant that you own or have permissions for your User Content; it is accurate and lawful; and it does not infringe third-party rights.
Removal. We may remove, block, or disable access to User Content at our sole discretion without notice and are under no obligation to return or preserve such content.

4. Vendor Content

Ownership & License. Vendors retain ownership of content uploaded to listings and grant Pixokart a worldwide, royalty-free, transferable, sublicensable license to host, display, reproduce, adapt, distribute, and promote such content for operating and marketing the Services.
Accuracy & Legality. Vendors are solely responsible for ensuring content (including pricing and certifications) is accurate, lawful, and does not infringe third-party rights. Pixokart does not independently verify vendor content.
Warranties & Indemnity. Vendors warrant they have all rights to their content and will indemnify Pixokart for claims arising from vendor content.

VII. Customer Reviews & Feedback Policy

Customer Obligations. Reviews must reflect genuine first-hand experiences; must be truthful and lawful; and must not include incentives, offensive material, personal data of others, or conflicts of interest.
Vendor Limitations. Vendors may not post or manipulate reviews for themselves or competitors, nor offer incentives for reviews.
Pixokart Rights. We may monitor and moderate reviews and remove those that violate this Policy or applicable law.
License to Reviews. By submitting a review, you grant Pixokart a worldwide, non-exclusive, royalty-free, perpetual, transferable, sublicensable license to use and distribute the review for operation and promotion of the Services.
Limitation. Reviews are user opinions; Pixokart does not verify their accuracy and disclaims liability arising from reliance on them.

VIII. User Conduct

By using the Services, you agree to act lawfully, respectfully, and responsibly. Without limitation, you shall not upload unlawful or infringing content; engage in harassment, fraud, scraping, hacking, malware distribution, or attempts to bypass our systems or fees; misuse booking or payment tools; or collect personal data without consent. Violations may result in content removal, account suspension or termination, reporting to authorities, and legal action.

IX. Customer Responsibilities

Provide accurate registration and booking information and keep it current.
Use the Services for lawful, personal purposes and do not attempt to bypass platform processes or fees.
Honor payments and review applicable cancellation/refund policies.
Engage respectfully with vendors; report disputes through Pixokart support channels.
Post truthful, experience-based reviews without conflicts of interest.
Comply with applicable laws (including data protection and consumer rights).

X. Vendor Responsibilities

Provide accurate, current information about business, services, pricing, and availability; update promptly.
Hold and maintain required licenses and comply with applicable laws.
Honor confirmed bookings; deliver services professionally and as advertised.
Adhere to Pixokart payment policies and do not solicit or transact outside the Platform for Pixokart-initiated customers.
Ensure uploaded content is authorized and non-infringing; respond to customer complaints in good faith.
Protect customer data; use it solely for fulfilling bookings and lawful purposes.
Understand that customer reviews are independent; do not manipulate them.

XI. Third-Party Content & Links

The Services may include third-party materials, listings, advertisements, offers, and links to external sites. Pixokart does not control or endorse third-party content and is not responsible for its accuracy, legality, quality, or availability. Your dealings with third parties are solely between you and them.

XII. Content Guidelines, Community Guidelines & Privacy

By using the Services, you acknowledge and agree to comply with Pixokart’s Content Guidelines, Community Guidelines, and Privacy Policy, each incorporated by reference into these Terms. We may disclose personal information where legally required or to protect our rights and users, consistent with applicable law.

XIII. Restrictions on Use & Enforcement

You agree not to engage in prohibited conduct, including unlawful, harmful, or deceptive activities; infringement; impersonation; spam; or attempts to interfere with or access the Services or accounts without authorization. Pixokart may monitor use, investigate suspected violations, remove content, and enforce these Terms, including terminating access where appropriate.

XIV. User Feedback & Idea Submission Policy

Feedback. If you submit ideas or suggestions (“Feedback”), you grant Pixokart a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to use and exploit such Feedback without compensation or acknowledgment.
Unsolicited Submissions. Pixokart does not accept unsolicited ideas for campaigns, products, technologies, or designs. If you submit them regardless, they become Pixokart’s sole property without obligation of confidentiality, review, or compensation.

XV. Advertising

Advertising Revenue. The Services may display targeted ads. The manner and extent may change without notice.
Third-Party Ads & Promotions. Responsibility for compliance of submitted ad material rests with the submitting party.
Sponsored Vendor Listings. Vendors may purchase premium placements; outcomes are not guaranteed.
Dealings with Advertisers. Your communications or transactions with advertisers are solely between you and them; Pixokart is not liable for related losses.

XVI. Additional Terms: Online Studio Booking Service

Requests & Confirmations. Bookings are confirmed only after the studio accepts your request. Availability is determined at the time of request.
Fees. Currently, Pixokart does not charge booking fees; Pixokart does not guarantee fulfillment and is not responsible for no-shows or non-compliance by users or studios.
Modifications & Cancellations. These are to be agreed between users and studios; disputes must be resolved directly by the parties.
Personal Data Sharing. You consent to share your contact details with studios for booking purposes; misuse by studios is not Pixokart’s responsibility.
Limitation. Pixokart acts solely as a platform connecting users and studios and is not liable for in-person interactions or service outcomes.

XVII. Disclaimer of Warranties; Limitation of Liability; Indemnification

1. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, completeness, reliability, and non-infringement. We do not warrant that the Services will meet your requirements, be uninterrupted, secure, or error-free, or that defects will be corrected.

2. Limitation of Liability

To the fullest extent permitted by law, Pixokart and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for loss of profits, goodwill, data, or business opportunities, arising out of or related to your use of or inability to use the Services, third-party dealings, or content inaccuracies.

3. Indemnification

You agree to indemnify, defend, and hold harmless Pixokart and its affiliates, officers, employees, and partners from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Services, your breach of these Terms, or your violation of third-party rights.

XVIII. Termination

User-Initiated. You may request deletion of your account via account settings or by contacting Pixokart.
By Pixokart. We may suspend or terminate access, with or without notice, including for violations of these Terms or inactivity. Termination may result in deletion of your data.

XIX. General Terms

Interpretation. Headings are for convenience only.
Entire Agreement. These Terms, together with the Privacy Policy, Content Guidelines, Community Guidelines, and any program-specific terms, constitute the entire agreement.
Severability. If any provision is unlawful or unenforceable, the remaining provisions remain in effect.
No Partnership or Agency. Nothing creates a partnership, joint venture, or agency; you may not bind Pixokart.
Governing Law & Time to Bring Claims. Applicable laws of India govern these Terms. Any claim must be commenced within one (1) year after it accrues.
Carrier Rates. You may incur mobile/data charges from your provider.
Linking. You may link to Pixokart, but may not frame the Services or link from unlawful or infringing sites. We may revoke linking permission at any time.

XX. Notice of Copyright Infringement & Grievance Redressal

Pixokart respects intellectual property rights and may remove or disable access to infringing content. Repeat infringers may have access terminated.

To submit a takedown notice, provide the following:

Identify the copyrighted work claimed to be infringed.
Identify the allegedly infringing material and provide sufficient information to locate it (exact URL within Pixokart).
Your statement: “I have a good faith belief that the use of the content as described is not authorized by the copyright owner, its agent, or the law.”
Your statement: “I swear under penalty of perjury that the information in this notice is accurate and I am the copyright owner or authorized to act on the owner’s behalf.”
Your contact details (address, phone, email) and your physical or electronic signature.
